I love this new topic.  People pledged for a ship with a set cockpit and now CR has changed it to something different and people are up in arms, but yet, the white knights are all coming out and stating that CR has every right to change ship designs, regardless what you pledged for.

MY GOD.  The FTC needs to shut these bastards down and get all of our money back.  Hope CR goes to jail for a long time.

This was CSR response in about 3 minutes:
        Hello Quibbly
Thank you for your comments.  They are not the same item.  As mentioned, the item you have pledged for is still in production, and is being shipped later this year.  Again, if you are looking to pursue a legal route, I am afraid that is something the CS team are unable to assist or get involved with directly, and I therefore advise referring to my previous response for the information you need.

        All the best,

        Kraiklyn

So, they are not the same?  Um…. a physical item is a physical item.

Well, if you want more ammunication for FTC, BBB and Class Action Law Suits, well, just go take a look at their store.

          https://robertsspaceindustries.com/pledge/merchandise

Are you saying “WHAT?  Are they selling physical models that are in stock but they haven’t shipped my physical models that I payed for in over 1-2 years?”   You have that right.  This is where they will get in trouble for scamming customers.    If you purchased a package and they are telling you “When the game is ready” or “Maybe at the end of the year”.  This is bait and switch.  All they care about is funding funding funding, but not delivering, delivering, delivering.

They can then say “Well, it was a pledge”.  Um, buying a package for physical items is not a “Pledge”. Also, when you purchased a package like many of you all have and never received, when you purchased, the package, there is no documentation stating the physical items would be delivered “When the game is ready”.

I have been trying to get a refund when I contacted them 30 days after my $299.00 purchase last year.  Their answer was “We never promised any physical items until the game is ready so your refund is denied”.  Now they are telling me “Possibly end of 2016″.

I have given them every opportunity to refund, but yet, same response from <span style=”color: #444444; font-family: ‘Lucida Grande’, Verdana, Arial, sans-serif; font-size: 12px; line-height: 18px;”>CS Rep: Kraiklyn.

Now I have every legal right to file a “Charge Back”.  I already informed them because of the bait and switch tactic and actually tried to say “That is illegal to do that”.  Well, taking my money and not delivering items is illegal.  I give a hit about the game, but more for the physical items because I thought they were pretty cool and a way to fund the project.

Well, they can also call in the “Eula” which they have changed multiple times from my agreement.  The game changed from what I paid for.  Time to contact my CC company with all my documentation for a “Legal Chargeback”.

I’m excited to find a good class action and go after them.

At this point in time, they can ban me for posting in another forum all they want.  I promise you, someone there with CR will go to jail (or flee to another country).

This will go down as one of the largest scams in history for the gaming community.  What they release is pure crap.  The stories change daily and the CULT CR lovers really are insane.

I’m quibbly in the CR forums, after this comment, I’m sure to be banned:

Squadron 42 – A Wing Commander style single player mode, playable OFFLINE if you want.  Playable offline or online, co-op with friends, you sign up for a tour of duty with the UEE fleet, manning the front lines, protecting settlements from Vanduul warbands.

The is what I paid for. If CR is not going to honor what we paid for, then a refund is required.

I’m really getting a kick watching them fall apart.

I’ve been trying to get a refund for over a year and they first come back and ask how it was possible that I made the purchase for the package I have, then call me a liar, then come back and state “We didn’t promise the physical items until the game is finished”.  Actually, they are incorrect.  When you purchase a package, there is no statement anywhere stating the physical items will be delayed.

Now, more requests later, I stated this is a Ponzi scheme and this is the response from Kraiklyn:

“<span style=”color: #2b2e2f; font-family: ‘Lucida Sans Unicode’, ‘Lucida Grande’, Tahoma, Verdana, sans-serif;”><span style=”font-size: 14px; line-height: 22px;”>To clarify, we are not an enterprise that accepts investors. You pledge/donate to support the development of a game, not gain a financial return. Therefore, a Ponzi scheme is not something that has any basis here.”</span></span>

<span style=”color: #2b2e2f; font-family: ‘Lucida Sans Unicode’, ‘Lucida Grande’, Tahoma, Verdana, sans-serif;”><span style=”font-size: 14px; line-height: 22px;”>Actually, we did pledge for a game and this includes certain packages such as physical items.  They sell other physical items like t-shirts, hats, etc and the items are delivered in 30 days, not when the game is developed.  </span></span>

<span style=”color: #2b2e2f; font-family: ‘Lucida Sans Unicode’, ‘Lucida Grande’, Tahoma, Verdana, sans-serif;”><span style=”font-size: 14px; line-height: 22px;”>As for a Ponzi scheme, if they are taking money for personal gain with a promise of a product that doesn’t’ exist, it is a ponzi scheme.  </span></span>

                    Update #3.

After I filed my FTC complaint, put my company attorney on retainer and asked for their legal department information, I get a response back stating there must have been a mistake because I purchased a product that was discontinued in 2014, but yet I was able to purchase directly from their site in Jan 2015.  In Feb asked for my first refund.

I truly do not care what this cost me, this is a matter of principle and a company who lies to end users.  No where when I purchased the physical items does it say “When available” or “When game is completed”.  Bait and switch.
